Poser (“Poser”, “we”, “us”, “our”) operates https://posermarketing.com.auand provides AI-assisted creative production services for apparel brands. This policy explains how we handle personal information and is intended to meet our obligations under the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), the EU General Data Protection Regulation (GDPR) and UK GDPR, and US state privacy laws including the California Consumer Privacy Act as amended by the CPRA (“CCPA”).
For GDPR/UK GDPR purposes, Poser is the data controller for personal data processed through this site and our services. Contact us at contact@posermarketing.com.au for any privacy matter, including to reach our privacy officer.
1. Information we collect
You provide: name, email, phone, company, role, booking details, and any brand assets, briefs or messages you send us. Collected automatically: IP address, device and browser data, pages viewed, referring URLs and similar log data, and cookie or analytics identifiers where enabled. From third parties: scheduling data from Calendly when you book a call. We do not intentionally collect special category / sensitive information and ask that you do not send it.
2. How we use it and our lawful bases
We use personal information to: respond to enquiries and provide services (GDPR Art. 6(1)(b) contract); operate, secure and improve the site (Art. 6(1)(f) legitimate interests); send service communications and, where required, marketing with consent (Art. 6(1)(a)); and comply with legal obligations (Art. 6(1)(c)). Under the APPs we only use information for the purpose it was collected or a directly related purpose you would reasonably expect.
3. Disclosure and sub-processors
We share personal information with service providers who process it on our behalf, including: Cloudflare (hosting, storage, CDN), Calendly (call scheduling), and our analytics provider if enabled. Each is bound to use the data only for the services they provide to us. We do not sell personal information, and we do not “sell” or “share” it for cross-context behavioural advertising as those terms are defined under the CCPA. We may disclose information if required by law or to protect our rights.
4. International transfers
We are based in Australia and our providers may process data in the United States, the EU and elsewhere. Where personal data is transferred out of the EEA/UK we rely on appropriate safeguards such as Standard Contractual Clauses. By using the site you understand your information may be processed outside your country of residence.
5. Retention
We keep personal information only as long as needed for the purposes above, to meet legal, tax and accounting requirements, and to resolve disputes. Enquiry and project records are typically retained for up to 7 years; server and analytics logs for a shorter period. We then delete or de-identify it.
6. Your rights
Everyone: you may request access to, and correction of, your personal information.
EU/UK (GDPR): you have rights of access, rectification, erasure, restriction, portability, and objection, and the right to withdraw consent at any time. You may lodge a complaint with your local supervisory authority (in the UK, the ICO).
Australia (APPs): you may request access and correction and complain to us. If unsatisfied you may complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
California (CCPA/CPRA): you have the right to know, delete, and correct personal information, to opt out of sale/sharing (we do not sell or share), to limit use of sensitive information, and to non-discrimination for exercising your rights. You may use an authorised agent. Other US states provide similar rights and we honour them where applicable.
To exercise any right, email contact@posermarketing.com.au. We will verify your request and respond within the time required by the applicable law (generally 30 days under GDPR, 45 days under the CCPA).
7. Cookies and analytics
We use strictly necessary cookies to run the site. Any analytics or non-essential cookies are only set where permitted, and in the EU/UK only with your consent. The Calendly widget loads only when you reach the booking section and sets its own cookies under Calendly's policy. You can control cookies through your browser settings.
8. Security
We take reasonable technical and organisational measures to protect personal information, including encrypted transport (HTTPS), access controls and reputable infrastructure providers. No method of transmission or storage is completely secure.
9. Children
The site and services are intended for businesses and are not directed to children under 16. We do not knowingly collect their personal information.
